网络环境下青少年心理健康教育研究

网络的推广与普及给青少年的身心带来了巨大的影响,它在拓宽青少年认知结构空间、促进其情绪宣泄和培养青少年多元价值观的同时,也容易导致青少年认知能力迷失、人际关系淡漠、生活意志丧失、抑郁、焦虑、敌对等一系列的心理问题。而我国当前在青少年网络心理问题的治疗过程中,存在着禁止青少年上网、只进行德育训诫、重治轻防和治疗人员专业水平较低等问题。提高青少年心理健康教育的效果,应建立家庭、学校和社会三位一体的教育和预防机制,开展网络心理教育,注重法制教育、德育教育与心理教育的有机结合并提高青少年网络心理疾病治疗人员的专业化水平。     

Joint effects of prior start-up experience and coping strategies on entrepreneurs’ psychological well-being

Drawing on theories from the coping and entrepreneurship literatures, we investigated the relationship between the entrepreneurs’ active and avoidance coping on psychological well-being (PWB) and the moderating role of prior start-up experience on this relationship. Data from 156 entrepreneurs indicate that the use of avoidance coping positively predicted immediate PWB for entrepreneurs with more start-up experience. Notably, this relationship was negative for entrepreneurs with less start-up experience. We also found that over the extended period, entrepreneurs who used avoidance coping had improved PWB only if they also used active coping. Theoretical and practical contributions to the entrepreneurship and coping research are discussed.     

Encouraging extra-role behavior in a channel context: The role of economic-, social-, and justice-based sharedness mechanisms

In export businesses where overseas agents enjoy much better knowledge of customers, competitors and institutional environments, a major challenge facing export channel management is encouraging extra-role behavior in forms of agents' spontaneous, cooperative, and innovative actions when formulating and executing strategic decisions for export markets. This study addressed this major challenge by developing an integrated model of agents' extra-role behavior which proposed that the exercise of economic, social, and justice related sharedness mechanisms when making and executing strategic decisions of channel partnerships can be expected to have a positive effect on channel relationship performance. The model was tested by a sample of 353 exporting manufacturers. The empirical evidence showed that channel relationship performance was strongly and positively affected by exporters' perception over agents' extra-role behavior over strategy formulation and execution. Exporting firms are advised to enhance likelihood of agents' extra-role behavior over strategy formulation and execution by expanding inter-organizational sharedness mechanisms in the forms of agents' contract inclusiveness, agents' relationship trust, and agents' decision-making procedural justice.     

无固定期限劳动合同的一个疑难问题研究

《劳动合同法》把“连续两次订立固定期限劳动合同,续订劳动合同的”作为劳动者要求与用人单位签订无固定期限劳动合同的条件之一,学者对此多有误读,必须予以纠正;此项法律规定本身也不完善,建议修改为“连续三次订立固定期限劳动合同的”。     

小型家族企业非家族员工心理契约违背研究

小型家族企业作为中小企业的一种常见形态,在对待非家族员工问题上一直没有非常科学的方法,这对于企业成长极为不利.究其原因,心理契约违背是内在主要原因.而由于小型家族企业自身特殊性,使得其非家族员工心理契约违背呈现违背感强烈且涉及面广等特点.而小型家族企业的期望源的不真实性、兑现的不完全性、企业的人格化、契约重构能力的缺失又是心理契约违背产生的主因.正因如此,小型家族企业要从心理契约构建及维护两大方面入手优化与非家族员工的心理契约,从根源上解决小型家族企业的这一难题.     

篮球运动员的心理特征及其赛前心理训练方法探讨

赛前的心理问题往往导致运动员在比赛中动作失调、变形、丧失信心。要使运动员在比赛中战术水平得到淋漓尽致的发挥,就需要教练员较好地了解和掌握篮球运动员的心理特征并能有针对性地进行赛前心理训练和指导。     

Why is hospitality employees’ psychological capital important? The effects of psychological capital on work engagement and employee morale

This study examines work engagement as a partial mediator of the effect of psychological capital (PsyCap) on employee morale in a sample of hotel employees. A survey was carried out with 312 front-line staff from 15 five-star hotels in Seoul, Korea. A one-month time-lag design (Time 1: PsyCap and work engagement; Time 2: employee morale) was used to reduce potential common method bias. The hypothesized relationships in the model were tested using structural equation modeling. The results suggest that work engagement partially mediates the effect of PsyCap on job satisfaction and affective organizational commitment. Specifically, front-line employees with high PsyCap are more engaged with their work and more likely to display job satisfaction and affective organizational commitment. The study concludes with a discussion of its empirical findings, strengths, theoretical contributions, and practical implications. Limitations and their implications for future studies are also reviewed.     

从网络点击合同效力分析看消费者权益法律保护

网络点击合同的效力不等同于传统格式合同效力,从主体缔约能力的确定、意思表示的真实性、电子格式条款的效力判定分析有助于维护消费者权益,实现网上交易的公平。设立网店实名制度和撤销权制度等配套制度、规制网络点击合同电子格式条款是网络消费者权益保护的法律应对措施。     

论合同解除的溯及力

合同解除的溯及力是合同解除制度中的一个重要问题，也是理论和司法实践中极富争议的一个问题。在合同解除的溯及力学说中，直接效力说、间接效力说等学说无法解决合同解除后恢复原状与损害赔偿并存的理论困境。清算说则可以避免这种矛盾，在理论上解决了恢复原状请求权与损害赔偿请求权难以并存的难题。我国未来合同法的发展应注意借鉴清算说，从而完善我国的合同解除制度。
